Terms of Service

These Terms of Service ("Terms") govern your access to and use of bestapp.co (the "Service"), operated by Herofly ("we", "us", "our"). By accessing the Service, submitting a listing, or placing a bid, you agree to be bound by these Terms. If you do not agree, do not use the Service.

You must be at least 18 years old, or the age of majority in your jurisdiction, to place a bid. If you are acting on behalf of a company, you represent that you have authority to bind that company to these Terms.

bestapp.co is a public, pay-to-rank leaderboard. Ranking is determined solely by the amount paid. There is no editorial review, no algorithm, no quality assessment, and no endorsement of any listed project. A higher position on the leaderboard means only that more money was paid for that position — nothing more.

A listing is a purchase of advertising placement. It is not an investment, a security, a subscription, a partnership, or a guarantee of traffic, revenue, exposure, conversions, or any other business outcome.

• The minimum bid to claim a spot is $5 USD.
• To take over an existing position, your bid must exceed the current bid by at least 5% (minimum $1).
• Your position becomes active only after payment is successfully confirmed by our payment processor.
• Positions are not permanent. Anyone may outbid you at any time, and you will not be notified when this happens.
• You may bid again as many times as you like. Each bid is a separate, independent purchase.

We may adjust minimum-bid rules, increments, categories, or leaderboard mechanics at any time. Changes apply prospectively and do not entitle you to a refund of bids already placed.

Payments are processed by Polar.sh, which acts as merchant of record. By completing checkout you also agree to Polar.sh's own terms and privacy policy.

All payments are final and non-refundable. This includes — without limitation — cases where you are outbid shortly after paying, where you are dissatisfied with the traffic or results received, where you submitted incorrect project details, or where you change your mind. Prices are in USD and exclude any taxes that may apply in your jurisdiction.

Initiating a fraudulent chargeback or payment dispute is a material breach of these Terms. We reserve the right to remove the associated listing immediately, retain the disputed funds where permitted, and permanently ban you from the Service.

You are solely responsible for the content you submit, and you warrant that you have the right to submit it. You may not submit a listing that:

• Is illegal, or promotes illegal goods, services, or activity in any applicable jurisdiction
• Contains malware, phishing, scams, deceptive redirects, or cloaked destinations
• Infringes any third party's intellectual property, trademark, or publicity rights
• Impersonates another person, company, or brand, or misrepresents your affiliation with one
• Contains sexual content involving minors, non-consensual content, or content sexualizing real people without consent
• Promotes hate, harassment, violence, self-harm, or terrorism
• Advertises unlicensed financial services, unregistered securities, or fraudulent investment schemes
• Contains malware-adjacent "grey market" offerings such as credential stuffing tools, stolen data, or account-takeover services
• Points to a URL you do not own or are not authorized to promote

By submitting a listing you grant us a non-exclusive, worldwide, royalty-free licence to display the submitted name, URL, handle, description, logo, and category on the Service and in related promotional material about the leaderboard itself.

We may remove any listing, refuse any bid, or suspend access to the Service at our sole discretion — with or without notice — including where we believe a listing violates Section 5, harms users, exposes us to legal risk, or damages the integrity of the leaderboard.

Removal for a violation of these Terms does not entitle you to a refund. If we remove a listing for reasons unrelated to your conduct (for example, we discontinue a category), we may at our sole discretion offer a credit or partial refund, but we are not obliged to.

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, that click counts or analytics will be perfectly accurate, or that a listing will generate any particular level of traffic or outcome.

We do not endorse, vet, verify, or take responsibility for any listed project. Any dealings you have with a listed project are solely between you and that project.

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, lost business opportunities, or loss of goodwill, arising out of or relating to the Service — even if we have been advised of the possibility of such damages.

Our total aggregate liability arising out of or relating to the Service is limited to the total amount you paid to us in the ninety (90) days preceding the event giving rise to the claim.

You agree to indemnify, defend, and hold harmless Herofly and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected with content you submit, your use of the Service, or your violation of these Terms or of any law or third-party right.

We may modify, suspend, or discontinue any part of the Service at any time. We may also revise these Terms; the "Last updated" date reflects the most recent revision. Your continued use of the Service after a revision takes effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the jurisdiction in which Herofly is established, without regard to conflict-of-law principles. You agree to first attempt to resolve any dispute informally by contacting us. If a dispute cannot be resolved informally, it shall be subject to the exclusive jurisdiction of the competent courts of that jurisdiction.

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. Our failure to enforce a provision is not a waiver of it. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.
